Terms and Conditions

These terms and conditions apply to the use of NOZAIA, provided by Iconiqdesign (Chamber of Commerce (KvK) number 77966473, VAT number NL003265032B62), hereinafter "NOZAIA".

1. Definitions

Platform: the NOZAIA software for managing a calendar, bookings and payments.
Salon: the business owner who registers to use the platform.
End client: the person who books an appointment through a salon's booking page.

2. Applicability

These terms and conditions apply to every salon that registers for NOZAIA. By registering, you agree to these terms and conditions and to our privacy policy.

3. The account and the trial period

New salons receive a free 14-day trial period. No payment method is needed to start it. Nothing is charged during the trial period, and nothing is charged at all unless the salon chooses a subscription plan. A salon that chooses a plan and adds a payment method during the trial period is charged for the first time when the trial period ends; cancelling before then is free of charge. After the trial period, a paid subscription is required to continue using the platform.

4. Subscriptions and payment

NOZAIA offers several subscription plans (Start, Pro, Studio) with monthly billing via Stripe. Current prices are shown on the platform itself. Founding Members receive the benefits set out in their signed Founding Member agreement: a free period on the Pro plan, followed by six months at 20% off, after which regular prices apply. Early Members receive the discount shown on the pricing page at the time they join.

Payment is made monthly by direct debit/card payment. If payment is not received, access to the platform may be suspended.

5. Term and cancellation

The subscription renews automatically each month. You can cancel at any time via the platform; the cancellation takes effect at the end of the current billing period. There is no minimum contract term.

6. Use of the platform

As a salon, you are yourself responsible for:

The accuracy of the data you enter (services, prices, opening hours)
Compliance with applicable laws and regulations towards your own clients (including consumer law and VAT)
Handling your end clients' personal data with due care
Keeping your login details confidential

7. Bookings and deposits between salon and end client

NOZAIA facilitates the booking and any deposit, but the agreement for the booked service is concluded between the salon and the end client. NOZAIA is not a party to that agreement and is not responsible for the performance of the booked service, its quality, or any disputes relating to it. A salon's cancellation and no-show policy is determined by that salon itself and communicated to the end client.

8. Availability and maintenance

We make every effort to ensure the highest possible availability of the platform, but do not guarantee uninterrupted availability. We may carry out planned maintenance without prior notice if this is necessary.

9. Liability

Iconiqdesign is not liable for indirect damage, consequential damage or loss of profit. Our liability is in all cases limited to the amount in subscription fees paid by the salon in the three months preceding the event giving rise to the damage.

10. Intellectual property

All rights to the platform, the software and the NOZAIA brand are vested in Iconiqdesign. A salon retains all rights to its own content (logo, photos, texts) that it places on the platform.

A salon may use the platform to run its business, during a trial and afterwards. It may not copy the platform, or any part of it, and may not reproduce, adapt or reuse the design, the screens, the texts, the structure or the underlying software. It may not reverse engineer or decompile the software, except to the extent mandatory law allows this and only after asking us first.

Access is for the salon and its staff. A salon may not give access to a party that builds, or has built, a competing product, and may not use the platform or a trial to build such a product, to have one built, or for competitive analysis or benchmarking.

Screenshots and recordings of a salon's own use are allowed and welcome: showing clients or colleagues how you work, or posting about it, is not copying. What is not allowed is using those images to rebuild the platform.

11. Changes

We may amend these terms and conditions. In the event of a material change, we will inform salons by email in advance. If you continue to use the platform after the date of the change, you agree to the amended terms and conditions.

12. Governing law

These terms and conditions are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
